OUTSOURCING AGREEMENT
Yesterday, April 05 of 2021, the main representatives of the labor and business sectors, officials of Mexico’s Government, as well as representatives of the Legislative Power met with the President Andrés Manuel López Obrador, in order to reach the following agreements:
- Prohibition of outsourcing of personnel
- Regulation of the outsourcing of specialized services distinct of the corporate purpose and of the preponderant economic activity of the contracting party.
- Registration in the Ministry of Labor and Social Welfare and registration and enrollment in the public registry of these specialized services and works companies.
- Joint and several liability in case of non-compliance
- A three month period in order to move the subcontracted workers to the payroll of the real employer
- New modalities to calculate the distribution of employee profit-sharing
It’s important to mention that these agreements have lack of legal formality and they constitute a political pact in order to regulate, in the following days, the figure of outsourcing in accordance with the legislative procedure.
