2025 Increase in Labor Fines

With amounts ranging from 5,675 to 5,657,000 pesos, all fines established in labor legislation have been updated as of February 1.

Fines for non-compliance with the Federal Labor Law (LFT) will increase this year, reaching up to 5.6 million pesos in some cases. The new amounts came into effect on February 1 as a result of the adjustment in the Unidad de Medida y Actualización (UMA) (Unit of Measurement and Update).

In 2025, the UMA will have a daily value of 113.14 pesos, representing an annual adjustment of 4.2%. This affects the calculation of penalties, credits, pensions, and other aspects. The Instituto Nacional de Estadística y Geografía (INEGI) (National Institute of Statistics and Geography) is responsible for setting this amount each year.

The LFT establishes specific sanctions for violations such as subcontracting regulations, payment of benefits, profit-sharing, workplace discrimination, or obstruction of labor inspections.

This year, new fines have been introduced for non-compliance with the recently established legal framework for digital platform work, which are among the highest fines in the Federal Labor Law. This reform was approved last year by the Congreso de la Unión (Congress of the Union) and will come into effect in mid-2025.

These are some of the fines applicable this year:

• Subcontracting regulations: between 225,280 and 5,657,000 pesos.

• Digital platforms and failure to register an employment contract: between 226,280 and 2,828,500 pesos.

• Profit-sharing: between 28,285 and 565,700 pesos.

• Obstruction of labor inspection: between 28,285 and 565,700 pesos.

• Failure to pay the year-end bonus (aguinaldo): between 5,675 and 565,700 pesos.

• Compensation for working on a public holiday: between 5,675 and 565,700 pesos.

• Committing or tolerating harassment or discrimination: between 28,285 and 565,700 pesos.

• Interfering in union activities: between 28,285 and 565,700 pesos.

• Failure to attend a conciliation hearing: between 5,675 and 11,314 pesos.

In all cases, fines may be imposed per affected worker and do not exempt employers from complying with legal provisions.
