REGISTRATION OF INDIVIDUALS THAT PROVIDE SERVICES OR EXECUTE SPECIALIZED WORK
Today May 24, 2021 an agreement was published in the Federal Official Gazette by which the general provisions for the registration of individuals or legal entities that provide specialized services or execute specialized work referred in the article 15 of the Federal Labor Law were published.
Specialized services or works are those that have distinctive elements of the activity performed by the contractor, such as training, certifications, permits or licenses that regulate the activity, equipment, technology, machinery, risk level, average salary range and experience, which provide added value to the beneficiary.
Individuals or legal entities that provide specialized services or works must be register before the Public Registry of Contractors of Specialized Services or Specialized Works, through the platform http://repse.stps.gob.mx. In this platform, all the requested information must be uploaded, in order to be granted a folio number.
Once registered on the platform the Ministry of Labor and Social Security
(hereinafter “the Ministry”) will have 20 business days to pronounce on the registration request. If “the Ministry” didn’t pronounced within this period, the interested party may request that the corresponding registration notice be issued within 3 business days after the submission of the request. If “the Ministry” doesn’t answer in the following 3 business days, the registration will be considered accepted.
The registration must be renewed every 3 years through the platform and this renewal must begin within the 3 months prior to the date on which the validity of your registration ends.
Those who obtain the registration will be obliged to identify their workers by means of identifications, in order to link them with the company that provides the specialized services or executes the specialized work during their work at the facilities of the company that hires them. Likewise, the registration and folio of the activity or specialized work of such companies must be recorded in the contracts entered into with companies that provide services or perform specialized works.
