EMERGENCY HEALTH AGREEMENT BY REASONS OF FORCE MAJEURE

Yesterday, the General Health Council issued an agreement declaring the SARS-CoV2 virus disease epidemic (COVID-19) a health emergency due to force majeure. The measures that were issued, in summary, consist of the following:

1.- Immediate suspension, from 30 March to 30 April 2020, of “non-essential activities” in the public, private and social sectors. The list of what are considered essential activities will be published later.

2.- Measures of healthy distance.

3.- Fulfillment of home protection from March 30 to April 30, 2020 as far as possible.

4.- Obligatory home protection for people over 60 years of age or with high blood pressure, diabetes, heart or lung disease, imonusuppression, in a state of pregnancy or immediate postpartum.

5.- Staggered and regionalized return to work activities once this suspension of activities is concluded, according to what is issued by the Secretary of Health.

6.- All electoral processes, censuses and surveys shall be postponed until further notice.

7.- All measures must be applied with strict respect for and adherence to human rights.

Considerations:

These measures constitute recommendations of a health nature without legal effectiveness in the world of work, for which reason we are not yet faced with a “declaration of health contingency” that implies the obligation to suspend labour relations in accordance with articles 42 bis and 429 section IV of the Federal Labour Law.

Therefore, we urge you to seek agreements and conclude agreements with the workers in order to modify their working conditions or suspend the working relationship, taking into account the health measures recommended to us in order to prevent the spread of the virus.
