Incorporation of household workers
On February 18 of the current year, the new pilot program was announced through the official website of the Mexican government to guarantee access to social security for domestic workers under the same conditions as the rest of the workers, which started on the 1st of April and which will last 18 months.
For purposes of the program, it is understood as domestic workers those who provide cleaning, assistance and other services, own or inherent to the home, of a person or a family. These people can provide their services in favor of one or several employers and live or not in their place of work.
The beneficiaries will obtain medical services, hospital, pharmacists, obstetric care, disabilities, pension for disability and life, fund for retirement, as well as social benefits within which are waits and nurseries.
To be a beneficiary of the pilot program, it will be necessary for the worker to obtain his social security number and to register with the Mexican Social Security Institute (hereon “IMSS” by its acronym in Spanish). The employer, according to the agreement with the worker, will have to provide a monthly payment by prepayment to the IMSS, which will depend on the income received by the worker and that must range from a minimum salary to the equivalent value of 25 units of measurement and update (hereon “UMA” by its acronym in Spanish), equivalent to $ 63,367.50 monthly, so, if the worker earns a minimum wage, that is $ 3,080.40 pesos per month, the social security fee will have to be $ 904.22 according to the tab published by the IMSS. In case the worker has two or more employers, the contribution should be divided proportionally among them.
Finally, we would like to point out that this is a pilot program and, therefore, it is not a legal obligation nowadays, however, the intention is to take the current program to the Mexican Congress, so that tomorrow may become law.
